The undersigned athlete/participant understands, acknowledges and agrees that a condition and requirement of participating in the Run with the Chums 5k Fun Run/Walk (“the Event”) is to enter into this Assumption of Risk, Release and Waiver Form, and to assume all risks of participation in the Event by signing below.
The Event can be a dangerous activity and exposes the athlete/participant to the risk of personal injury, death, or other harmful consequences, which may arise directly or indirectly as a result of participation in the Event. The athlete/participant acknowledges and agrees that he/she is fully aware of the risks and hazards inherent in participating in the Event and hereby elects to voluntarily participate, knowing the risks associated with the Event. By participating in the Event, the athlete/participant is representing and warranting that he/she is in good physical condition and is able to safely participate in the Event.
In consideration of being allowed to participate in the Event, the athlete/participant hereby voluntarily and knowingly assumes all risks of loss(es), damage(s), or injury(ies), including but not limited to physical injury or death, that may be associated with or sustained by him/her while participating in the Event.
In consideration of being allowed to participate in the Event, the athlete/participant on behalf of himself/herself and on behalf athlete/participant’s personal representatives, assigns, heirs, executors, and successors hereby voluntarily and knowingly fully and forever releases, waives, discharges, covenants and agrees not to sue the Washington State Department of Fish & Wildlife or its employees or other related officials; Whatcom Conservation District or its employees or other related officials; and BP Products North America Inc. (“BPPNA”) or its parent and affiliated entities, successors and assigns, officers, directors, shareholders, employees, contractors or any other person or entity acting on behalf of BPPNA (the foregoing, collectively the “Releasees”), and the Releasees will not be liable to you or any other person for any claims, losses or damages of any nature whatsoever, arising out of or in connection with your participation in the Event or the use, in any way, of Releasees’ property, assistance, sponsorship or co-sponsorship, regardless of legal theory or whether arising in or by statute, tort, contracts, strict liability, or otherwise.
The athlete/participant has carefully read this Assumption of Risk, Release and Waiver Form and warrants that all statements made herein are true and correct and understands that Releasees have relied on them in allowing athlete/participant to participate in the Event.
THE ATHLETE/PARTICIPANT INTENTIONALLY AND VOLUNTARILY SIGNS THIS ASSUMPTION OF RISK, RELEASE AND WAIVER FORM. IF THE ATHLETE/PARTICIPANT IS UNDER AGE 18 HIS/HER PARENT OR GUARDIAN MUST SIGN THIS ASSUMPTION OF RISK, RELEASE AND WAIVER FORM AND AGREE TO BE BOUND HEREBY.
The athlete/participant 's Parent’s or Guardian's signature below certifies that, as his or her son/daughter/ward, the athlete/participant has the Parent’s or Guardian’s
permission to participate in the Event. The athlete/participants Parent or Guardian has read and understands the foregoing ASSUMPTION OF RISK, RELEASE AND WAIVER FORM (above) and by signing intentionally and voluntarily agrees to its terms and conditions. The athlete/participant 's Parent or Guardian further certifies that his or her son/daughter/ward is in good physical condition and is able to safely participate in the Event.
I am aware that it is a full release of all liability and sign it of my own free will.
